Learning outcomes

the course is intended –in general terms- to create in the students a certain awareness of the themes of intellectual and industrial property and –in particular- to transmit the basic concepts of the legal regulation of technological innovation.
Therefore the course will concern essentially the legal regulation of patents and will give special attention to chemical and biotechnological inventions

Syllabus

the program considers:
- introduction to the system of exclusive rights in intellectual and industrial property;
- outline of the patent function;
- general distinctions: patent and copyright; patented and non patented inventions;
- basic notions about patented inventions: definition, requirements of patentability; procedure up to grant; rights arising from invention; invention of employees and on order; extension of patent protection and importance of claims and description; invalidity and estinction: outline of circulation of the patent; outline of the judicial protection and of the role of “court expert”; territoriality of patent rights and aspects of internationality;
-non patented invention and protection of industrial secret;
- chemical invention;
-biotechnological invention;
-new plant varieties (outline only).
